Liquor Control (Liquor Bans in Public Places) - Summary of Proposed Main Changes
- Extend the existing liquor controls at Cockle Bay, Tainui Reserve, Omana, Maraetai, Umupuia, Beachlands, Te Puru, Howick Village, Howick Beach and Mellons Bay to 24 hours, 7days a week.
The existing liquor controls apply from:
- 7pm on Thursday night, all day Friday, Saturday and Sunday to 7am on Monday morning; and
- 7pm on the day before to 7am on the day after all public holidays and Guy Fawkes.
The proposed change would extend the liquor control to include all day Monday, Tuesday, Wednesday and Thursday.
Extend the existing liquor controls at Marine Parade and Muir Avenue Reserve to 24 hours, 7days a week. The existing liquor controls apply in the evening from 7pm to 7am every day of the week.
Reasons:
- To reduce confusion to police and public alike. Eg. at Cockle Bay beach some (not all) parking spaces and the playground are subject to a 24 hour 7 days a week liquor control, but the beach and grass areas are subject to a extended weekend, public holiday and Guy Fawkes liquor control.
- To preclude instances of incorrect signage.
- To address alcohol related problems outside of the current times.
- Clarify that existing beach liquor controls extend to mean low water springs. This affects Bucklands Beach, Eastern Beach, Kiwi Esplanade, Cockle Bay, Omana, Maraetai, Umupuia, Beachlands, Te Puru, Howick Beach, Mellons Bay and Marine Parade.
Reason:
- The current liquor control maps are based on property boundaries which in many instances do not show parts of the beach above high tide or at low tide.
- Extend the area of the existing liquor controls at Otamariki Park, Rongamai Reserve, Papatoetoe Town Centre, Mellons Bay, and Marine Parade.
Reasons:
- To address omissions in the current liquor ban maps for Otamariki Park, Rongamai Reserve, Papatoetoe Town Centre.
- To address problems in Mellons Bay identified by Counties Manukau Police in the vicinity of the road side car parks at the very end of Mellons Bay Road.
- To address problems in Marine Parade liquor ban area identified by residents between Marine Parade, Tranquillity Close and Oceania Place.
- Make new liquor controls on Falstaff Place reserve and adjacent road, Cascades Walkway between Whitford Road and Meadowland Drive (opposite Meadowlands Shopping Plaza), and on all roads
subject to under 3,500kg vehicle weight class prohibitions.
Reasons:
- To address problems identified by the Counties Manukau Police.
- Clarify that liquor controls do not apply to alfresco dining on licensed premises.
Reasons:
- This is not explicit in the bylaw and at times has resulted in uncertainty.
Important notes:
- Liquor controls do not affect private premises, licensed premises (including alfresco dining), persons transporting liquor, and permission may be given to allow liquor at special events.
- Liquor controls are enforced at the discretion of the Counties Manukau Police whose aim is to prevent or address alcohol related problems in public places.
- Existing 24 hour 7 days a week liquor controls are proposed to remain unchanged
- on all council controlled playgrounds, carparks, skateparks;

Speed Limits - Summary of Proposed Main Changes
- Amend the form and style of the bylaw for consistency with other bylaws.
- Eliminate duplicate and redundant provisions adequately dealt with by other Acts and Rules, particularly the Land Transport Rule: Setting of Speed Limits 2003.
- Provide Attachments to the bylaw which provide a register of speed limits set by Council (but which do not form part of the bylaw itself).
- Change speed limits including:
- Redefinition of the Urban Traffic Area to include the developing area of Flat Bush, Point View Drive (and side roads) and Redoubt Road – Regis Lane (and side roads). This redefinition means that all existing roads, and future roads created through subdivision, in these areas will have a 50km/hour speed limit unless the Council specifically determines otherwise.
Reason:
- To respond to urban growth.
- Introduction of a Variable Speed Limit on roads near 17 schools where 40km/h will apply on school days for 35 minutes at school commencement, 20 minutes at school conclusion, and other times when required for pedestrian safety, and the existing 50km/h speed limit will apply at other times.
Reason:
- To enhance safety outside schools.

Vehicle Weight Class Prohibition - Summary of Proposed Main Changes
- Remove the maximum fine specified in the bylaw and rely on the fine and infringement fee provisions of the Local Government Act 2002 and Transport Act 1962.
Reason:
- To remove inconsistency between the issue of $750 instant fines by the Counties Manukau Police and the maximum fine on summary conviction (a more serious charge) of only $500 specified in the bylaw.
Important note:
- Vehicle prohibitions are enforced at the discretion of the Counties Manukau Police whose aim is to address problems associated with heavy vehicles and illegal street racing.
Temporary Signs Bylaw - Summary of Main Changes
To introduce standardised rules and requirements for election signs for the October 2010 triennial general elections for the Auckland region required by the Local Government (Tamaki Makaurau Reorganisation) Act 2009.
