Objections to liquor licence applications.

Objections to liquor licence applications:

  • May be made by any person who has a greater interest in the application than the public generally
  • Must be in writing and filed with the District Licensing Agency within 10 working days after the first publication of the public notice making of the application.

Grounds for objections to new, on or off licences

  1. The suitability of the applicant.
  2. The days on which and the hours during which the applicant proposes to sell liquor.
  3. The areas of the premises or conveyance, if any, that the applicant proposes should be designated as restricted areas or supervised areas.
  4. The steps proposed to be taken by the applicant to ensure that the requirements of this Act in relation to the sale of liquor to prohibited persons are observed.
  5. The applicant's proposals relating to -
    1. The sale and supply of non-alcoholic refreshments and food; and
    2. The sale and supply of low-alcohol beverages; and
    3. The provision of assistance with or information about alternative forms of transport from the licensed premises.
  6. Whether the applicant is engaged, or proposes to engage, in -
    1. The sale or supply of any other goods besides liquor and food:
    2. The provision of any services other than those directly related to the sale or supply of liquor and food,
    3. and, if so the nature of those goods or services.
  7. Any matters dealt with in any report made under section 11 of this Act.

Note: "The Licensing Authority shall not take into account any prejudicial effect that the grant of the licence may have on the business conducted pursuant to any other licence".

Grounds for objections to renewal applications

  1. The suitability of the licence.
  2. The conditions attaching to the licence.
  3. The manner in which the licence has conducted the sale and supply of liquor pursuant to the licence.

Note: "The Secretary shall send a copy of every objection to the applicant."
